This Returns Policy governs the exercise of the right of withdrawal and the return conditions applicable to purchases made through the UPTAK website. This policy is understood without prejudice to the commercial preorder cancellation policy prior to expected delivery, where applicable, provided in the Terms and Conditions of Purchase.


1. Can I return my purchase?

In accordance with Article 102 of the Consolidated Text of the General Law for the Defence of Consumers and Users, the consumer or user is generally entitled to a period of fourteen (14) calendar days to withdraw from the contract without giving any reason.

In contracts for the sale of goods, the withdrawal period begins on the day on which the consumer, or a third party other than the carrier indicated by the consumer, acquires material possession of the product.

In the case of purchases made under the presale or preorder modality, the legal right of withdrawal shall begin to run from the effective receipt of the product, without prejudice to any commercial policy of cancellation prior to expected delivery provided by UPTAK.


2. Exceptions to the right of withdrawal

In accordance with Article 103 of the Consolidated Text of the General Law for the Defence of Consumers and Users, the right of withdrawal shall not be applicable in those cases in which any of the legally foreseen exceptions apply.

Among others, exceptions may apply relating to goods made according to consumer specifications or clearly personalised, goods that may deteriorate or expire quickly, or any other cases legally foreseen.


3. How to exercise the right of withdrawal

To exercise the right of withdrawal, you must inform UPTAK of your decision to withdraw from the contract by means of an unequivocal statement sent to the email address hello@uptak.com or by post to the registered address indicated in the contact section.

You may use, if you wish, the model withdrawal form included as Annex I in the UPTAK Terms and Conditions available on the website. However, you may also exercise your right of withdrawal by any other unequivocal statement sent to hello@uptak.com within the legally applicable period.

In order to meet the withdrawal deadline, it is sufficient for the communication regarding the exercise of this right to be sent before the corresponding period has expired.


4. Effects of withdrawal and refund

In the event of valid withdrawal, UPTAK shall refund the consumer all payments received for the purchase, including, where applicable, the standard delivery costs initially paid.

The refund shall be made without undue delay and, in any case, within fourteen (14) calendar days from the date on which UPTAK is informed of the decision to withdraw.

However, UPTAK may withhold the refund until the goods have been received, or until the consumer provides sufficient proof of their return, whichever condition is met first.

Direct costs for returning the product shall be borne by the customer, unless applicable regulations provide otherwise or the return is due to an error by UPTAK, lack of conformity, damaged product or incident attributable to UPTAK.


5. Return conditions

Returned products must be sent in suitable conditions of preservation and properly protected to avoid damage during transport.

The consumer shall only be liable for the diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the product.

Whenever possible, the return should be made with the original packaging or with equivalent packaging ensuring the proper protection of the product.

It is recommended to include a copy of the invoice, proof of purchase or order reference to expedite processing.


6. Defective, damaged or incorrect products

If the product received shows damage, defects, lack of conformity or does not correspond to the order placed, the customer must notify UPTAK as soon as possible through hello@uptak.com.

In such cases, UPTAK shall handle the incident in accordance with applicable regulations on conformity and legal guarantee, assuming, where appropriate, the costs of collection, return, replacement, repair or refund.


7. Professional or business purchases

The legal right of withdrawal recognised in this policy applies only to consumers and users under the terms provided by consumer protection regulations.

Purchases made by companies, professionals or entities within the scope of their business or professional activity shall not be subject to the legal right of withdrawal, unless UPTAK expressly recognises it contractually or commercially.
